1. General

These Terms of Service apply to all users of the site, including browsers, customers, merchants, and contributors of content. By using this website, you confirm that you are at least 18 years of age, or are accessing it with the consent of a parent or legal guardian. These terms apply to all transactions made on toppickstore.in.

2. Products & Pricing

  • We reserve the right to modify or discontinue products at any time without prior notice.
  • Prices are listed in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise.
  • We reserve the right to change prices at any time. Price changes will not affect orders that have already been confirmed.
  • We make every effort to display accurate product images and descriptions. Slight variations in colour or appearance may occur due to screen settings — these do not constitute a defect.
  • All product listings are subject to availability. In the event of a stock-out after your order is placed, we will contact you and offer a full refund.

3. Orders

  • By placing an order, you confirm that all information provided is accurate and complete.
  • We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, incomplete address, or stock unavailability.
  • If your order is cancelled after payment, a full refund will be issued within 5–7 business days.
  • An order confirmation email/SMS is not a guarantee of fulfilment — it confirms receipt of your request. We will notify you separately if an order cannot be fulfilled.

4. Payment

  • Payment must be made at the time of purchase for prepaid orders via UPI, debit/credit card, or net banking.
  • For COD (Cash on Delivery) orders, payment is made in cash at the time of delivery.
  • We use Razorpay and other PCI-DSS compliant payment processors. By making a payment, you agree to their respective terms and conditions.
  • TopPick does not store any payment card details on its servers.

7. Product Safety & Baby Products

TopPick curates and sells products intended for everyday consumer use. For baby and children's products listed on our store:

  • Products are sourced from established suppliers and are intended for their stated use cases.
  • Always supervise children during product use. Do not leave infants unattended with any product.
  • Check all products for damage before use. Discontinue use and contact us if a product appears defective.
  • Product images and descriptions are for illustrative purposes. Actual product colours/designs may vary.
  • TopPick is the reseller, not the manufacturer. For any manufacturing safety concerns, please contact us and we will facilitate resolution with the supplier.

8. Intellectual Property

All content on this website — including text, images, logos, graphics, and product descriptions — is the property of TopPick and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content without our prior written permission.

9. Limitation of Liability

TopPick shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our products or website. Our maximum liability to you shall not exceed the total amount paid for the specific product or order in question. We are not liable for damages resulting from misuse of products, failure to follow product instructions, or use by persons other than the intended user group.

10. IT Act Compliance (India)

This website is operated in compliance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. For any complaints or grievances related to content or transactions on this platform, please contact our Grievance Officer at support@toppickstore.in. Grievances will be acknowledged within 24 hours and resolved within 15 days.

11. Consumer Protection

These Terms of Service are subject to the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020. Nothing in these terms is intended to limit or waive your statutory rights as a consumer under Indian law.

12. Governing Law & Jurisdiction

These Terms of Service are governed by the laws of India. Any disputes arising from or related to these terms or any transaction on this website shall be subject to the exclusive jurisdiction of the competent courts in India.
